New Legislation on Identifying Transgender Individuals: The Broader Transgender Community in India Feels Betrayed
The Transgender Persons (Protection of Rights) Amendment Bill, 2026, has been approved by Parliament, modifying previous legislation to refine the definition of "transgender." This new law requires certification from a medical board for identity verification and eliminates the self-identification rights that were previously in place. The transgender community is expressing their dissatisfaction and protesting, as they were not included in the discussions. The updated Act excludes genderqueer, trans-men, and trans-women from its definition, instead concentrating on "eunuchs" and individuals with intersex variations. Consequently, only certified eunuchs will be acknowledged as legal transgender individuals with rights.
